Religious Counselors’ Strategies in Encouraging Applications for the Legalization of Unregistered Marriages in Alla Sub-District, Enrekang Regency (2022–2024)

Abstract

Based on field observations, unregistered marriages (nikah siri) are still found among the community in Alla Sub-District, Enrekang Regency, although not openly and in relatively small numbers. This study aims to explore the phenomenon of nikah siri in Alla Sub-District and to analyze the strategies employed by religious counselors in encouraging marriage legalization through isbat nikah. Using a descriptive qualitative method, data were collected through observation, interviews, and documentation involving officers from the Office of Religious Affairs (KUA), community leaders, religious leaders, the religious court, and couples who submitted isbat nikah applications. The findings reveal that nikah siri persists due to several factors, including administrative obstacles, economic burdens such as traditional dowry (uang panai), and limited understanding of the procedures and importance of official marriage registration. The strategies adopted by religious counselors include persuasive, educative, and collaborative approaches, utilizing religious forums, social activities, and cooperation with village governments and religious figures. These strategies are adaptive and contextual, contributing to increasing public legal awareness, although they have not yet fully reduced the practice of nikah siri. Furthermore, their overall effectiveness cannot be fully ascertained since not all unregistered marriages can be detected.
