Abstract

This study aims to analyze the implications of globalization for the continuity of customary law systems and to examine the dynamics of interaction between local values and global modernization. In plural societies such as Indonesia, globalization not only offers opportunities through information exchange and expanded social networks, but also presents challenges to the position of customary law as a normative source regulating communal life. Economic modernization, technological penetration, and global cultural influences have the potential to shift the role of customary law, particularly in terms of the authority of customary institutions, traditional dispute-resolution practices, and the legitimacy of customary norms within the national legal system. This study employs a literature review method by examining various theoretical and empirical studies related to globalization, social change, and the revitalization of customary law across different local communities. The findings show that globalization has ambivalent implications: on one hand, it drives the erosion of traditional values, yet on the other hand, it opens space for adaptation, institutional strengthening, and formal recognition of customary law through state policies. These findings highlight the importance of strategies for protecting and revitalizing customary law so that it remains relevant and able to function as cultural identity and a normative source within the national legal framework.
