Scope
Indonesian Journal of Matrimonial and Family Law, a peer-reviewed journal, provides a forum for publishing research findings in the fields of Matrimonial and Family Law, Customary Law, and Islamic Family Law within the Indonesian context. This journal is designed and devoted to academics, researchers, legal practitioners, policymakers, and students who wish to publish their original research reports and literature review articles (by invitation only). The journal welcomes a diverse range of scholarly works that contribute to a deeper understanding of Indonesia's pluralistic legal landscape concerning family and marriage.
The whole spectrum of research in Indonesian matrimonial and family law is welcome, which includes, but is not limited to the following topics:
1. Matrimonial and Family Law This topic covers the study of statutory and civil laws governing marriage and family in Indonesia, including the Marriage Law No. 1 of 1974. It provides a platform for research that critically analyzes legal frameworks, judicial practices, and the implementation of family-related policies in civil courts. The scope also extends to comparative analysis of Indonesian law with other national or international legal systems.
2. Customary Law (Hukum Adat) This field is dedicated to research on traditional legal systems and customs that regulate marriage, inheritance, and family relationships in various regions across Indonesia. Papers in this area explore the principles of hukum adat, its role in contemporary society, and its interaction with state law. The journal welcomes studies on how customary practices are preserved, adapted, or challenged in the modern legal and social environment.
3. Islamic Family Law (Hukum Keluarga Islam) This topic focuses on the study of Islamic legal principles and their application to family life in Indonesia. It includes research on the Compilation of Islamic Law (KHI), the jurisdiction of Religious Courts, and the legal aspects of marriage, divorce, inheritance, and child custody for Muslim citizens. The journal is a forum for scholarly work that examines legal interpretations, reforms, and the socio-legal dynamics of Islamic family law in the Indonesian context.
