Abstract

This study aims to examine the role of the Religious Court in handling divorce cases in Enrekang Regency during 2021–2022 and to identify the contributing factors that lead to divorce in the community. This research employed a qualitative analytical method with data collection techniques including observation, documentation, and interviews with the Registrar and Judges of the Religious Court of Enrekang. The findings indicate that the role of the Religious Court in managing divorce cases involves first assessing the grounds for divorce, providing advice to disputing parties, and offering mediation services. Furthermore, the study revealed several key factors contributing to divorce, namely alcoholism, gambling, abandonment of a spouse, domestic violence, infidelity, prolonged disputes, apostasy, economic hardship, and physical disability. These findings highlight the multifaceted role of the Religious Court in both adjudicating and mediating divorce cases, while also underlining the complex social and personal issues that drive marital dissolution in Enrekang Regency. This research contributes to a deeper understanding of the judicial and societal dimensions of divorce in Indonesia, particularly within the scope of religious courts.
